Terms and Conditions

Introduction:

These Terms and Conditions (“Terms”) govern the contractual relationship between you (“Client”) and Gohabesha (hereinafter referred to as the “Company”) regarding the booking and participation in any travel product(s)/service(s) (“Trips”) offered by Gohabesha. By booking any product(s)/service(s) with Gohabesha or by participating in any Gohabesha experience, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Booking Contract:

• A booking is confirmed, and these Terms shall apply, upon Gohabesha’s receipt of the applicable deposit from the Client and written confirmation provided by Gohabesha.
• The Client confirming the booking must be at least 18 years of age and agrees to provide accurate information as requested by Gohabesha.
• In case of multiple clients named and booked on a single booking, the client confirming the booking is deemed to have accepted these Terms on behalf of all clients named in the booking.
• Gohabesha reserves the right to decline any booking in its sole discretion.

Confirmation and Itinerary Subject to Modification:

• Upon receipt of the deposit, the Client will receive a confirmation email. Any itinerary provided is subject to change at the discretion of Gohabesha due to various factors.

Payments:

• Total Payment: The Total Payment is due before the start date of the Trip. Failure to make full payment by the Payment Due Date may result in cancellation of the reservation, forfeiting the deposit and any payments made.
• Deposit: All deposits and payments are non-refundable. However, payments can be held as a credit or transferred to a future trip upon cancellation.
• Late Payment: Failure to make payments on time may result in cancellation of the reservation, and a late fee may be incurred.

Cancellation by the Client:

• Any cancellation must be delivered to Gohabesha in writing and acknowledged by Gohabesha. Cancellations within the specified notice period are non-refundable and non-transferable.
• Trip Cancellation Insurance is recommended to cover any non-refundable expenses.

Refunds:

• All payments made towards the balance of the trip are non-refundable after a certain period. Refunds will only be provided if the trip is cancelled in its entirety by Gohabesha.

Unused Services:

• Gohabesha does not offer discounts or refunds for missed or unused services unless it’s due to Gohabesha’s fault.

Passport, Visa, and Related Items:

• Clients are responsible for obtaining and maintaining valid passports, visas, permits, and other required documentation for the duration of the Trip.

Travel Insurance:

• Clients are required to obtain their own travel insurance covering all activities included in the Trip.

Changes or Cancellations:

• Gohabesha reserves the right to make changes to the Trips and itinerary due to various reasons. Clients will not be eligible for refunds based on such changes.
• Clients acknowledge and accept the inherent risks associated with travel and permit reasonable alterations to the itinerary by Gohabesha.

Cancellation by Company:

• Gohabesha reserves the right to cancel reservations if payments are not received on time or due to insufficient registrants. In such cases, refunds may be provided, but Gohabesha will not be responsible for any additional expenses incurred by the Client.

Health & Fitness Eligibility, Strenuous Activity, and Injury:

Voluntary Participation in Strenuous Activity: You acknowledge that you are voluntarily participating in the Trips with Gohabesha, which may involve strenuous physical activity, including but not limited to walking, running, hiking, dancing, climbing, swimming, jumping, surfing, yoga, and various other exercises or physical activities (“Physical Activity”). You acknowledge the risks and hazards associated with participating in the Trips and/or engaging in Physical Activity, including the risk of serious injury or death. By participating, you voluntarily assume these risks.

Health and Fitness Eligibility: You represent that you are over the age of eighteen (18) and are in good physical and mental health, suitable for participation in the Trips and any associated Physical Activities. You further represent that you do not suffer from any medical conditions or disabilities that may restrict or prevent your participation. You have consulted with your physician and obtained clearance to participate. You acknowledge that the Trips may take place in remote areas with limited access to medical facilities, and you are responsible for any medical expenses incurred.

Assumption of Risk: You understand that accidents may occur during Physical Activities, and you assume full responsibility for the risks involved. You acknowledge that Gohabesha is not liable for any injuries sustained during the Trips or related activities. By participating, you solely and exclusively assume all risks associated with travel and engaging in Physical Activity.

Injury: In the event of injury during the Trips, you agree to assume all medical costs incurred. Gohabesha and its affiliates are not liable for any losses or liabilities arising from your participation in the Trips.

Waiver of Liability and Release: In consideration of participating in the Trips, you voluntarily release, waive, and discharge Gohabesha, its officers, agents, employees, and representatives from any and all claims, demands, actions, or losses arising from your participation. You acknowledge that Gohabesha is not responsible for any injuries or liabilities.

Indemnity & Binding Effect: You agree to indemnify and hold harmless Gohabesha and its affiliates from any liabilities incurred as a result of your participation in the Trips. This agreement binds you and your heirs, assigns, and representatives.

Validity: The prices and details advertised are subject to change, and Gohabesha reserves the right to alter trip details before the contract is concluded.

Client Responsibility: You acknowledge the risks associated with adventure travel and assume personal responsibility for your safety and well-being during the Trips.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain valid and enforceable.

Images and Marketing: You consent to the use of your likeness in marketing materials by Gohabesha and its affiliates.

Group Photos: Group photos may be taken during the Trips for promotional purposes. You may opt-out of participating in these photos.

General: This agreement constitutes the entire agreement between you and Gohabesha and is governed by DC Law. Gohabesha reserves the right to refuse service to any client.

Disclaimer: You accept that trip details are subject to change, and there are inherent risks associated with physical activities during the Trips. You acknowledge and assume responsibility for these risks.

By booking with Gohabesha, you agree to abide by these Terms and any amendments made by Gohabesha from time to time.

Changes to Terms Gohabesha reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined
